Last week I attended the ANZPATH conference in Adelaide. It was a great opportunity to meet some new people. The conference was covered on ABC 7.30 Report and the Saturday ABC news. Filming occurred for an episode of Four Corners.


The Sexual Reassignment Act 1988

The Sex Reassignment Act 1988 (SA) is no longer good law. It places unfair and awkward restrictions on who may provide health care services to sex and gender diverse people and limits the access of children of diverse sex and gender to personally affirm the gender that they feel rather than a sex or gender that is forced on them,

In no other state in Australia is access to medical care legislated and requiring of special registration. The registration requirement in the act and the fines for practicing in the field without being registered with the Health Department under the legislation are a barrier to encouraging people to work in the field.

Most states merely have a small section under birth registrations in the Birth's Deaths & Marriages Act that allows for a person who has undergone sex affirmation procedures to have their birth certificate amended or for those born elsewhere to be issued with a recognition certificate.

Tammy Franks Has raised concern about the requirement for a married person to be divorced before a recognition certificate can be issued.

this I would suggest should be considered as a separate issue to the repeal of the act. Provision should be made available under equal opportunity law access to services irrespective of chosen gender.


In the past people referred to transsexualism as if it was a sex change when in reality for most people who experience the situation they will recount that they have felt a particular gender since a young age. ( there are some transgender people for whom this is not the case)

Since the case of Re:kevin in the last decade the courts have recognised the innate identity of the individual


I would like to see the Equal Opportunity Law amended from the current "chosen gender" to "gender identity" were a person affirms their gender by means of dress and or medical affirmation.
. Chosen gender sends a wrong message to those who would discriminate against those who would seek to use the attribute for protection.
gender identity , just as sexual orientation , eye colour and left or right handedness is not a choice.
